This presentation will analyze the recent and conflicting federal circuit court decisions on whether indirect discharges of pollutants to navigable waters via hydrologically-connected groundwater require permitting under the Clean Water Act. This is a timely topic that the U.S. Supreme Court may weigh in on in 2019. We will also discuss the implications for permitting and compliance if the circuit court decisions holding that a Clean Water Act permit is required for such releases to groundwater ultimately are upheld or otherwise left standing.
